Terms & Conditions

1. Introduction & Agreement

1.1. Welcome to AceHaematology. These Terms and Conditions ("Terms") govern your use of the AceHaematology website, content, and services (collectively, the "Service").

1.2. The Service is owned and operated by Marrowminds Ltd (trading as "AceHaematology"), a company registered in Scotland under company number SC847598, with a registered office at 41 Craigie Loanings, Aberdeen AB25 2PS ("we", "us", "our").

1.3. By registering for an account or using our Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Service. This is a legally binding agreement.

1.4. Privacy Policy: Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by this reference. By agreeing to these Terms, you also agree to the terms of the Privacy Policy.

2. Account Registration and Security

2.1. To use our Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep this information updated.

2.2. You are responsible for safeguarding your password and for all activities that occur under your account. You must not share your password or account access with any third party. You agree to notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

3. Subscriptions, Payments, and Renewals

3.1. Access to our Service requires a paid subscription. We offer various subscription plans (e.g., monthly, quarterly, 6-monthly) which will be detailed on our pricing page.

3.2. Your subscription will automatically renew at the end of each billing period for a subsequent period of the same duration.

3.3. Cancellation of Renewal: You may cancel the automatic renewal of your subscription at any time through your account settings page. Your cancellation will take effect at the end of your current billing period, and you will continue to have access to the Service until that date.

3.4. Price Changes: We reserve the right to change our subscription fees. We will provide you with at least 30 days' notice of any fee changes. Price changes will take effect at the start of the next subscription period following the date of the price change. By continuing to use the Service after the price change takes effect, you agree to pay the new subscription fee.

4. Right to Cancel & Refunds

4.1. Under the Consumer Contracts Regulations 2013, you have a right to cancel this contract within 14 days of your initial purchase without giving any reason.

4.2. The 14-day cancellation period begins on the day you purchase your subscription to the Ace Haematology question bank.

4.3. To exercise the right to cancel, you must inform us of your decision by a clear statement before you access the content (e.g., an email to acehaematology@gmail.com).

4.4. Effect of Cancellation: If you cancel the contract within the 14-day period before accessing the question bank, we will provide you with a full refund. We will make the reimbursement without undue delay, and not later than 14 days after the day on which we are informed about your decision to cancel.

4.5. Exception for Accessing Digital Content: Our service provides immediate access to digital content in the form of a question bank. By purchasing a subscription, you give your express consent to the immediate supply of this content and acknowledge that you will lose your right to cancel and receive a refund once you access the service. For the purpose of these terms, "accessing the service" is defined as logging into your account and viewing any question, answer, explanation, or starting any test or quiz on www.acehaematology.com. Once the question bank has been accessed, the service is considered to have been provided and you are no longer eligible for a refund.

5. Intellectual Property and Permitted Use

5.1. The Service and all of its original Content (including all questions, explanations, and text), features, and functionality are and will remain the exclusive intellectual property of Marrowminds Ltd and its licensors. The Service is protected by copyright and other laws.

5.2. Your subscription grants you a limited, non-transferable, non-exclusive license to access and use the Service and its Content for your own personal, non-commercial study purposes only.

6. Prohibited Uses

6.1. You agree not to use the Service for any unlawful purpose. You are expressly prohibited from:

  • Sharing your login credentials with any other person.
  • Reproducing, distributing, modifying, or creating derivative works of any Content without our express written permission.
  • Using any automated system or software to extract data from the Service ("screen scraping").
  • Using our Content for any commercial purpose, including group teaching or training, without a valid institutional license.

7. User-Generated Content: Blog & Discussion Boards

7.1. User Responsibility: The Service may include features such as a blog with comment sections and user discussion boards ("Interactive Features") that allow you to post, submit, and share content, including comments, questions, and other materials ("User-Generated Content"). You are solely and entirely responsible for the User-Generated Content that you post on or through the Service.

7.2. Community Guidelines & Acceptable Use: By using our Interactive Features, you agree that your User-Generated Content will not:

  • Be unlawful, defamatory, abusive, harassing, threatening, obscene, profane, hateful, racially or ethnically offensive, or otherwise objectionable.
  • Contain any confidential or personal information about any third party, especially patient-identifiable data. You are strictly prohibited from sharing information that could breach patient confidentiality. Clinical case discussions must be fully anonymised.
  • Infringe upon the copyright, trademark, patent, or other intellectual property rights of any other person.
  • Constitute spam, junk mail, chain letters, pyramid schemes, or any form of unsolicited commercial advertising or solicitation.
  • Impersonate another person or entity or misrepresent your affiliation with a person or entity.
  • Contain software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment.

7.3. Our Right to Moderate and Remove Content: AceHaematology does not have an obligation to pre-screen or monitor User-Generated Content. However, we reserve the right, in our absolute and sole discretion, to review, edit, refuse to post, or remove any User-Generated Content at any time and for any reason, without notice to you. This includes, but is not limited to, content that we believe violates these Terms or is otherwise harmful or inappropriate. We are not responsible for any failure or delay in removing such content.

7.4. No Endorsement: The opinions and views expressed in User-Generated Content are those of the individual authors and do not necessarily reflect the official position, policies, or views of Marrowminds Ltd or AceHaematology. We do not endorse or guarantee the accuracy, integrity, or quality of any User-Generated Content.

7.5. License Grant: By posting User-Generated Content on the Service, you grant Marrowminds Ltd a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User-Generated Content in connection with providing and promoting the Service. This allows us to legally display your contributions on our platform.

8. Our Content - Important Disclaimers

8.1. Medical Disclaimer: The Content provided on the Service is for educational and informational purposes only. It is designed to assist with exam preparation and is not a substitute for professional medical advice, clinical judgment, diagnosis, or treatment. You must not rely on the information in the Service as an alternative to medical advice from your doctor or other professional healthcare provider.

8.2. No Affiliation and Content Originality Disclaimer: AceHaematology is an independent educational resource and is not affiliated with, endorsed by, or in any way officially connected with the Royal College of Pathologists (RCPath) or any of its associated exam bodies. We do not have access to any proprietary or non-public examination materials from the Royal College. Our question bank and mock examinations are original content created in good faith for educational purposes. While our mock exams may be structured based on the publicly available RCPath exam blueprint, they do not intentionally include or replicate questions from any past or present official examinations. Any similarity to actual exam questions is purely coincidental. Furthermore, you are strictly prohibited from posting, sharing, or discussing specific questions from any official examination on our platform, including in the discussion boards or comments. We do not encourage or condone the sharing of "live" or recalled examination material.

8.3. Service Availability: While we strive to ensure the Service is available 24/7, we provide it on an "as available" basis. We do not warrant that the Service will be uninterrupted or error-free. We will, however, use reasonable skill and care to provide the Service and to correct any defects in a timely manner.

8.4. Content Accuracy: We use reasonable skill and care to ensure the accuracy and quality of our Content at the time of publication. However, the field of haematology is constantly evolving, and standards, guidelines, and exam formats can change. Therefore, we do not warrant or guarantee the absolute completeness, reliability, or accuracy of the Content. The Content is provided on an "as is" basis, and your use of it is at your own risk. It is intended for exam preparation purposes, and you are responsible for verifying information against primary sources and clinical guidelines where appropriate.

8.5. AI-Generated Content: You acknowledge that parts of the Content, including questions and explanations, may be generated or supplemented by artificial intelligence (AI) models. While we aim to review AI-generated information prior to publication, you understand that errors can happen, particularly when content is auto-generated. We have no control over and cannot perform independent verification of all such content, which may contain inaccuracies, errors, or "hallucinations" (outputs that are nonsensical or factually incorrect). It is your responsibility to use the Service with your own professional judgment. The Service is intended as a learning and revision support tool only and is not a substitute for primary-source study, clinical experience, or professional academic judgment. You must not rely on the Content as a sole source of absolute medical knowledge.

9. Our Liability to You

9.1. Nothing in these Terms shall limit or exclude our liability for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation; or
  • any matter in respect of which it would be unlawful for us to exclude or restrict liability.

9.2. As required by the Consumer Rights Act 2015, we will ensure that our digital content is of satisfactory quality, fit for purpose, and as described.

9.3. If our faulty digital content damages a device or digital content belonging to you, and we have not used reasonable care and skill, we will either repair the damage or pay you compensation.

9.4. Our total liability to you for all other losses arising under or in connection with these Terms shall be limited to the amount you have paid for your subscription in the 12 months preceding the claim. We are not liable for any indirect or consequential losses, or business losses, including but not limited to, lost profits, lost revenue, or any costs associated with exam fees, resits, or loss of professional opportunity.

10. Termination

10.1. By You: You may terminate your relationship with us at any time by cancelling your subscription renewal as described in Section 3.3.

10.2. By Us: We may terminate or suspend your account immediately and without notice if you commit a material breach of these Terms (including, but not limited to, the Prohibited Uses in Section 6).

11. Service Modifications

11.1. We reserve the right to modify, suspend, or discontinue the Service (or any part or content thereof) at any time with or without notice. We will not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service. We will, where reasonably possible, provide advance notice of any planned maintenance that may result in service interruption.

12. Changes to These Terms

12.1. We reserve the right to modify these Terms at any time. If we make a material change, we will provide you with at least 30 days' notice before the new terms take effect.

12.2. By continuing to use our Service after the revisions become effective, you agree to be bound by the revised terms.

13. Governing Law and Dispute Resolution

13.1. These Terms shall be governed and construed in accordance with the laws of Scotland.

13.2. Any dispute, controversy, or claim arising out of or in connection with these Terms will be subject to the non-exclusive jurisdiction of the Scottish courts.

13.3. If you are a consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions of local law.

15. General Provisions

15.1. Severability: If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

15.2. Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Marrowminds Ltd regarding our Service and supersede all prior agreements and understandings.

15.3. Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

15.4. Force Majeure: We shall not be liable for any failure to perform our obligations hereunder where such failure results from any cause beyond our reasonable control, including, without limitation, mechanical, electronic or communications failure or degradation.
